29 CFR 1910.23(b)(9):(9) Ladders are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury; a) On or about February 12, 2024, the employer did not ensure that the roof access ladder, located in the Health United Building, was being inspected prior to initial use for each work shift, as a result, employees were exposed to fall 17' fall hazard while climbing a ladder that had insufficient clearance (minimum of 15 inches of clear width on each side of the ladder centerline).

29 CFR 1910.22(d)(2):(2) Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired; and a) On or about February 12, 2024, the employer did not ensure that hazardous conditions, such as but not limited to sufficient clearance on either side of the ladder, were corrected or repaired on walking-working surfaces prior to allowing employees access the fixed ladder, located in the Health United Building. As a result, employees were exposed to a fall hazard of 17 feet while climbing the ladder that had insufficient clearance due to the permanent sprinkler system pipe.

29 CFR 1910.23(d)(13)(i): Fixed ladders. The employer must ensure: Fixed ladders that do not have cages or wells have: (i) A clear width of at least 15 inches (38 cm) on each side of the ladder centerline to the nearest permanent object; and a) On or about February 12, 2024, the employer did not ensure that there was at least a 15 inch clearance from the centerline of the fixed ladder located in the Health United Building in that a permanent sprinkler supply pipe on the north side of the ladder was 11.5' inches from the ladder's centerline. As a result, employees were exposed to a 17' fall hazard while climbing the ladder with insufficient clearance.
