29 CFR 1910.22(d)(2): Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired; and a) On and before March 23, 2025, the employer failed to correct the hazardous conditions of the arena in that guardrails were not installed after the bleachers were retracted on or before March 17, 2025, exposing employees to fall hazards greater than 6 feet.

(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a) On and before March 23, 2025, the employer failed to protect the edge of the spectator seating in section 116 , exposing employees working in the area to falls of 6 feet or greater to the concrete floor below.

29 CFR 1910.30(a)(1): Fall hazards. Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. a) On or before March 23, 2025, the employer failed to provide training for employees and subcontractor employees who were exposed to fall hazards in the Cintas Arena, in that employees change over the arena setting at least once a month. As a result, employees were exposed to fall hazards of approximately 6 feet to the concrete floor when the guardrails were removed and not replaced.
