29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or biological hazards encountered in a manner capable of causing injury or illness in the function of any part of the body through absorption, inhalation or physical contact. (a)Wilmot Care Center, Inc. at 501 4th Street, Wilmot, SD 57279: On or about and at times prior to February 12, 2024, the employer did not ensure that employees caring for SARS-CoV-2 positive residents were protected from disease or illness in that soiled cloth gowns were allowed to be hung outside of patient isolation rooms in the open hallway. This condition exposed employees to potential health hazards.

29 CFR 1910.134(f)(2): The employer did not ensure that employees using tight-fitting respirators were fit-tested prior to initial use, or whenever a different respirator facepiece (size, style, make or model) was used, and at least annually thereafter: (a)Wilmot Care Center, Inc. at 501 4th Street, Wilmot, SD 57279: On or about and at times prior to February 22, 2024, the employer did not ensure that new hired employees caring for SARS-CoV-2 positive residents were protected from respiratory illnesses in that fit-testing was not performed initially for employees who were required to wear respirators. This condition exposed employees to respiratory health hazards due to inadequate respirator fit. (b)Wilmot Care Center, Inc. at 501 4th Street, Wilmot, SD 57279: On or about and at times prior to February 22, 2024, the employer did not ensure that employees caring for SARS-CoV-2 positive residents were protected from respiratory illnesses in that fit-testing was not performed annually for employees who were required to wear respirators. This condition exposed employees to respiratory health hazards due to inadequate respirator fit. The Wilmot Care Center, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.134(f)(1), which was contained in OSHA inspection number 1508494, citation number 1, item number 1b and was affirmed as a final order on June 14, 2021, with respect to a workplace located at 501 4th Street, Wilmot, SD 57279.

This condition exposed employees to health hazards due to not being medically evaluated prior to respirator use. The Wilmot Care Center, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.134(e)(1), which was contained in OSHA inspection number 1508494, citation number 1, item number 1a, and was affirmed as a final order on June 14, 2021, with respect to a workplace located at 501 4th Street, Wilmot, SD 57279.
