29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) On or about May 14, 2024, the employer did not submit documentation and Certification of Corrective Action for citation 1 item 1 issued on April 1, 2024, with an abatement due date of April 18, 2024.  b) On or about May 14, 2024, the employer did not submit documentation and Certification of Corrective Action for citation 1 item 2 issued on April 1, 2024, with an abatement due date of April 18, 2024.  c) On or about May 14, 2024, the employer did not submit documentation and Certification of Corrective Action for citation 2 item 1 issued on April 1, 2024, with an abatement due date of April 18, 2024.  d) On or about May 14, 2024, the employer did not submit documentation and Certification of Corrective Action for citation 2 item 2 issued on April 1, 2024, with an abatement due date of April 18, 2024.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  On or about February 27, 2024, employees engaged in residential construction activities were exposed to fall hazards in excess of 6-feet without using any form of fall protection. This condition exposed employees to fall hazards and struck-by hazards.  MTM Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1656538, citation number 1, item number 1 and was affirmed as a final order on July 20, 2023, with respect to a workplace located at 13260 Coldham, Horizon City, TX 79928.  MTM Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard  29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1491976, citation number 1 , item number 1 and was affirmed as a final order on December 4, 2020, with respect to a workplace located at 170 Vin Marbella, El Paso, TX 79912.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about February 27, 2024, employees engaged in residential construction operations were exposed to fall hazards due to the employer not providing training. This condition exposed the employees to fall and struck-by hazards.   MTM Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1656538, citation number 1, item number 2 and was affirmed as a final order on July 20, 2023, with respect to a workplace located at 13260 Coldham, Horizon City, TX 79928.  MTM Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(c)(3), which was contained in OSHA inspection number 1491976, citation number 1, item number 2 and was affirmed as a final order on December 4, 2020, with respect to a workplace located at 170 Vin Marbella, El Paso, TX 79912.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables shall not be used.   On or about February 27, 2024, employees engaged in residential construction activities were exposed to an electrical shock hazard while using a worn/frayed electric extension cord to power a portable handheld grinder.
