29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On or about February 27, 2024, the employer did not ensure the employee assisting in roofing operations (ground worker) was protected from potential falling objects from above by the use of a protective helmet. This exposed the employee to a struck-by hazard from a height of twelve (12) feet by material remnants and tools above the working employee. (b) On or about February 27, 2024, the employer did not ensure the employee assisting in roofing operations from the first floor roof were protected from potential falling objects from the second floor roof above by the use of a protective helmet. This exposed the employees to a struck-by hazard from a height of seven (7) feet by material remnants and tools above the working employees.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purpose for which they were designed: (a) On or about February 27, 2024, employee(s) working on an existing residential structure were exposed to a fall hazard when the employer did not insure that the Keller six (6) foot self supporting portable step ladder used to access the second floor roof from the ridge of the 4:12 pitch first floor roof was used as designed. The six (6) foot step ladder was left in the closed position and leaned against the second story eave, while the employees used the ladder to access the higher roof. This exposed employee to a tipping over and fall hazard.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. (a) On or about February 27, 2024, employee(s) used gasoline powered, and pneumatic powered portable tools to include a leaf blower, a nail gun and a circular saw without eye protection while doing tasks to include blowing off waste roofing installation materials from the roof, after tear off, and during cutting and installation of decking. This exposed employees to eye injury. Nick's Roofing of Kenosha, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1554543, citation number 1, item number 1 and was affirmed as a final order on 01-25-2022 , with respect to a workplace located at 8580 Lexington Place, Pleasant Prairie, WI.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about February 27, 2024, employees conducting roofing work from the second floor of 4:12 pitch roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 19 feet on the North side and West side of the roof onto grass and concrete when employees were not tied into a fall protection system. (b) On or about February 27, 2024, employees conducting roofing work from the second floor of 4:12 pitch roof were not protected from falling to the first floor roof. This exposed employees to a fall hazard of approximately seven (7) feet to the first floor roof. (c) On or about February 27, 2024, employees conducting roofing work on the first floor roof and the porch roofs which are located on the South and East sides of the 4:12 pitch roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately twelve (12) feet onto grass and concrete when employees were not tied into a fall protection system.
