Manuel Alverez Chavez located at Building #3, 5500 Hildebrand Road, Columbus, OH 43230: On or about January 18, 2024,  the employer did not initiate and maintain accident prevention programs that included work rules, training, inspections and enforcement at a multi-unit residential construction site where framing sub-contractor employees were exposed to fall of over 30 feet, electrical and struck-by hazards.

Manuel Alverez Chavez located at Building #3, 5500 Hildebrand Road, Columbus, OH 43230: On or about January 18, 2024, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable the work environment. Employees were performing framing work exposed to fall, electrical and struck-by hazards during construction of a residential building.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a.  Manuel Alverez Chavez located at Building #3, 5500 Hildebrand Road, Columbus, OH 43230: On or about January 18, 2024, the employer did not ensure that employees exposed to falls were provided with a fall protection training program. Employees engaged in residential framing activities working at heights of over 30 feet, were not trained on the recognition of fall hazards and the procedures to be followed to minimize the hazards.

Safety of equipment shall be determined on the basis of the following considerations:  a. Manuel Alverez Chavez located at Building #3, 5500 Hildebrand Road, Columbus, OH 43230: On or about January 18, 2024, the employer failed to ensure electrical equipment was free from recognized hazards. Employees utilized portable electrical cords with damaged outer insulation to supply portable electrical power to tools and damaged strain relief devices, the following condition exposed employees to electrical hazards.

Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.  a.  Manuel Alverez Chavez located at Building #3, 5500 Hildebrand Road, Columbus, OH 43230: On or about January 18, 2024, the employer did not ensure employees were protected from electrical contact hazards while engaged in residential construction activities. Employees used a portable flexible power cord to supply power to portable electrical power tools. The power cable had a damaged strain relief device allowing internal cables to be visible and subject to damage.  The following condition exposed employees to electrical shock hazards.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Manuel Alverez Chavez  located at Building #3, 5500 Hildebrand Road, Columbus, OH 43230: On or about January 18, 2024, the employer did not ensure employees engaged in residential framing activities at heights over 6 feet were protected from falls. Framers were installing materials on a new residential building without any form of fall protection which exposed the employees to falls of over 30 feet.
