29 CFR  1926.451(a)(6):Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design.  a) Located at 6280 Marinelli Drive South Lots 192-196, Hilliard, OH 43026: On or about December 30, 2024, the employer did not ensure the scaffold in the garage was designed by a qualified person used to frame a two-story multi-family home. Employees were exposed to fall heights of approximately 8 feet.

29 CFR  1926.451(b)(2):Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide.  a) Located at 6280 Marinelli Drive South Lot 194, Hilliard, OH 43026: On or about December 30, 2024, the employer did not ensure the job made scaffold had a platform or walkway of at least 18 inches wide. The scaffold only provided a walkway of less than 12 inches, while exposing an employee to a fall height of approximately 8 feet.  b) Located at 6280 Marinelli Drive South Lot 195, Hilliard, OH 43026: On or about December 30, 2024, the employer did not ensure the job made scaffold had a platform or walkway of at least 18 inches wide. The scaffold only provided a walkway of less than 10 inches, while exposing an employee to a fall height of approximately 7 feet.

29 CFR  1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) Located at 6280 Marinelli Drive South Lots 192-196, Hilliard, OH 43026: On or about December 30, 2024, the employer did not conduct frequent and regular inspections of the job site. As a result, employees were exposed to fall hazards greater than 19 feet and struck-by hazards while performing residential construction.  Manuel Alverez Chavez was previously cited for a violation of its equivalent Occupational Safety and Health standard 29 CFR 191926.20(b)(1), which was contained in OSHA inspection number 1730971, citation number 1, item number 1 and was affirmed as a final order on June 3, 2024, with respect to a workplace located at Building #3, 5500 Hiddlebrand Road, Columbus, OH 43230.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Located at 6280 Marinelli Drive South Lots 192-196, Hilliard, OH 43026: On or about December 30, 2024, the employer did not ensure that employees framing were protected from falling by a fall protection system. As a result, employees were exposed to a fall hazard of greater than 19 feet while performing residential construction.  Manuel Alverez Chavez was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1730971, citation number 1, item number 5 and was affirmed as a final order on June 3, 2024, with respect to a workplace located at Building #3, 5500 Hiddlebrand Road, Columbus, OH 43230.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Located at 6280 Marinelli Drive South Lots 192-196, Hilliard, OH 43026: On or about December 30, 2024, the employer failed to ensure that each employee exposed to a fall hazard was trained on the hazards of falling and the procedures to minimize the hazards in the work area. As a result, employees were exposed to fall hazards greater than 19 feet while performing residential construction.  Manuel Alverez Chavez was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1730971, citation number 1, item number 2b and was affirmed as a final order on June 3, 2024, with respect to a workplace located at Building #3, 5500 Hiddlebrand Road, Columbus, OH 43230.
