29 CFR 1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) At 103 Barlow Way, Owens Cross Roads, AL: On or about 02/27/2024, the employer exposed employees to eye injuries, in that eye protection was not utilized while employees operating pneumatic nail guns.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  (a) At 103 Barlow Way, Owens Cross Roads, AL: On or about 02/27/2024 and at times prior, the employer exposed employees to fall hazards, in that fall protection was not  utilized by employees while installing OSB plywood.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at its top to a ridged support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the ladder:  (a) At 103 Barlow Way, Owens Cross Roads, AL: On or about 02/27/2024, the employer exposed employees to fall hazards, in that an extension ladder to gain access to the wood decking to install OSB plywood was not extended the required 3 feet above the upper landing surface.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
