29 CFR 1910.134(c)(1):  The respiratory protection program was not updated as necessary to reflect those changes in workplace conditions that affected respirator use:  a) 100 Boxwood Lane, York, PA 17402 - Paint Shop: On or about February 29, 2024, the written respiratory protection program was not updated as necessary to reflect changes in workplace conditions that affected respirator use. The program was not updated to reflect "Worksite Safety" conducting the respirator medical evaluations, fit-testing, and training, and did not include provisions for the use of full facepiece respirators at the facility for painting operations. Painters utilize hazardous paints and solvents while spray-finishing in paint booths while wearing full facepiece respirators or supplied-air respirators (SAR).   No abatement documentation or certification is required.

29 CFR 1904.29(a): The employer did not use an OSHA 300, 301 and 300A Form or equivalent.  a) 100 Boxwood Lane, York, PA 17402: On or about February 29, 2024, the employer did not use an equivalent form to OSHA's Form 300 Log of Work-Related Injuries and Illnesses in 2024. The employer's form did not include the following required elements: location in the facility where injury/illness occurred, employee's job title, injury/illness classification (designation of death, days away from work, job transfer/restriction, or other recordable case), number of days away from work or on the job transfer/restriction, and injury/illness type (designation of injury, skin disorder, respiratory condition, poisoning, hearing loss, or all other illnesses).  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
