29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about March 5, 2024, Employees engaged in residential construction framing operations were being exposed to fall hazards on the job site located at 3315 South 70th Street, Omaha, Nebraska 68106, in that the employer has failed to ensure the portable ladder used to access and egress upper levels is . In this instance employees were using an extension ladder for access and egress to and from the upper levels of the structure and the extension ladder in use did not extend at least 3ft above the upper landing surface.

29 CFR  1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:  On or about March 5, 2024, Employees engaged in residential construction framing operations were being exposed to fall hazards on the job site located at 3315 South 70th Street, Omaha, Nebraska, 68106, in that the employer failed to train employees on the hazards associated with ladders.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  On or about March 5, 2024, employees engaged in residential construction framing operations were exposed to fall hazards on the job site located at 3315 South 70th Street, Omaha, Nebraska 68106 in that the employer is failing to ensure employees working at heights greater than 6 feet are protected from fall hazards.  In this instance an employee was observed working at heights greater than 25ft without any form of fall protection.   Kikos Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(4)(i), which was contained in OSHA inspection number 1592018 , citation number 1, item number 3 and was affirmed as a final order on 5-19-2022, with respect to a workplace located at 10471 South 130th Plaza, Papillion, Nebraska 68133.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  On or about March 5, 2024, employees engaged in residential construction framing operations were exposed to fall hazards on the job site located at 3315 South 70th Street, Omaha, Nebraska 68106, in that the employer failed to verify through written certification employee training related to the identification of fall hazards as well as use and inspection of fall protection equipment. In this instance the employee with missing certification was working 25feet without fall protection.
