The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section. (a) On or about February 29, 2024, and at times prior, for employees exposed to respiratory hazards where employees broke concrete with jackhammers for approximately two work days in absence of a water delivery system or a dust collection system at or near 415 N Lake Street, Madison, Wisconsin.

29 CFR 1926.1153(e)(2): Where respirator use is required by this section, the employer shall institute a respiratory protection program in accordance with 29 CFR 1910.134: (a) On or about February 29, 2024 for employees exposed to respiratory hazards while engaged in jackhammering wearing negative pressure respirators in absence of medical evaluations or fit testing at or near 415 N Lake Street in Madison, Wisconsin. (b) On or about February 29, 2024 for an employee exposed to respiratory hazards while engaged in jackhammering wearing a negative pressure respirator while bearded at or near 415 N Lake Street in Madison, Wisconsin.
