29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  On or about November 12, 2024, at the jobsite located at 108 West New York Avenue, Oshkosh, Wisconsin; a worker was working in a trench that was more than approximately nine feet deep without any safe means of egress installed.

29 CFR 1926.651(e): Exposure to falling loads. No employee shall be permitted underneath loads handled by lifting or digging equipment. Employees shall be required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials. Operators may remain in the cabs of vehicles being loaded or unloaded when the vehicles are equipped, in accordance with 1926.601(b)(6), to provide adequate protection for the operator during loading and unloading operations.  On or about November 12, 2024, at the jobsite located at 108 West New York Avenue, Oshkosh, Wisconsin; a worker in an excavation was exposed to potential struck-by hazards while standing in a trench while the Pro-Tec Equipment Trench Shield (Model No.: PAL3-66SKE, Serial No.: 40611) was suspended from an excavator's arm.

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.  On or about November 12, 2024, at the jobsite located at 108 West New York Avenue, Oshkosh, Wisconsin; a worker was exposed to cave-in hazards while working in an unprotected excavation with a water accumulation of approximately seven inches of water at the bottom of the excavation.  The trench box was suspended above the employee, and only protected the employee on two of the four sides of the trench.

29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  On or about November 12, 2024, at the jobsite located at 108 West New York Avenue, Oshkosh, Wisconsin; a worker was exposed to potential cave-in hazards while working inside of a Pro-Tec Equipment Trench Shield (Model No.: PAL3-66SKE, Serial No.: 40611).  There was two sides of the trench box that were not protecting the employee from cave-in hazards, there was water actively accumulating in the trench, and the trench box had a defective strut pin and missing cotter pin in another strut pin.

29 CFR 1926.854(b): No wall section, which is more than one story in height, shall be permitted to stand alone without lateral bracing, unless such wall was originally designed and constructed to stand without such lateral support, and is in a condition safe enough to be self-supporting. All walls shall be left in a stable condition at the end of each shift.  On or about November 12, 2024, at the jobsite located at 108 West New York Avenue, Oshkosh, Wisconsin; employees were exposed to potential crushing hazards from an unbraced wall of the old lunchroom that was over one story in height.
