OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards:  a. On or about March 1, 2024, employees of Anstead Construction, LLC, performing work at 6625 Township Road 34 Rawson Ohio 45881, were exposed to struck-by and/or crushing hazards while working near and around the Bobcat skid steer model T76 (S/n: B4CE18635). The employer did not ensure safe working conditions of three concrete laborers who on the ground level, were performing concrete form construction, concrete preparation and installation activities in the direct vicinity of the skid steer operational area with limited visibility, prior to the struck by incident occurring.   Among other methods, feasible and acceptable means of abatement would be to:  1.)	Follow the Association of Equipment Manufacturers (AEM) Safety Manual for the Skid Steers and keep bystanders away from the operation area; always look before backing up; always look in the direction of travel; and drive forward whenever possible for best visibility.   2.)	Follow the Bobcat Company T76 operator's manual and loader safety training to always inspect the job site and check for bystanders, and wait for bystanders to leave the area before operating.   3.)	Install rear-view mirrors and/or a rear-view (reverse operation) camera kit onto the T76 (S/n: B4CE18635) skid steer approved by the equipment manufacturer to increase visibility behind the equipment and ensure bystanders are clear from the area.   4.)	Develop a Standard Operating Procedure, and provide training to employees, specific to operations when the skid steer and other heavy equipment are traveling in reverse, including requirements for the spotter and requirements to inform the operator and workers onsite of any and all hazards associated with working near and around excavators and other heavy equipment. This policy must provide for identifying a safe location where the spotters could observe the equipment and workers onsite, and provide hand signals or verbal instructions to the operator, or use telecommunication devices (e.g. two-way radio, telephone, etc.). Provide and ensure that the spotter wears high-visibility safety apparel that meets and is labeled with the Performance Class 3 ANSI/ISEA 107-2004.
