The employer did not ensure the scaffold platform used to elevate employees via a Skytrak telehandler forklift (serial #: LGE13202925) was designed by a qualified person. Employees performing construction activities in this condition were exposed to a fall of approximately 23 feet to the ground below.

29 CFR 1926.451(c)(2)(v):The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: a) Anstead Construction LLC. On or about April 30, 2024 at the address of 300 South County Rd. 198, Fremont OH 43420. The employer did not ensure scaffold platform used to elevate employees to their working level was secured to the forks of a Skytrak telehandler forklift (serial #LGE13202925). Employees using the scaffold platform in this condition were exposed to struck-by, fall and overturning hazards.
