29 CFR 1926.856(a): Mechanical equipment shall not be used on floors or working surfaces unless such floors or surfaces are of sufficient strength to support the imposed load: a) On or about 03/12/2024, during the demolition project at 80 North Main Street, located in Fairport, New York, the employer did not enforce safe working practices during the process of a concrete floor removal. A mechanical equipment, JLG G5-18A Telehandler, loaded with concrete floor slabs, was operated on a floor unable to support the machine. The floor beneath employees caved in and employees were exposed to falls into the floor opening and struck-by/against hazards from the broken concrete slabs. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.856(b):Floor openings shall have curbs or stop-logs to prevent equipment from running over the edge. a) On or about 03/12/2024, during the demolition project at 80 North Main Street, located in Fairport, New York, the employer did not enforce safe working practices while in the process of a concrete floor removal. A mechanical equipment (JLG G5-18A Telehandler) approached floor openings that did not have parking blocks, stops or curbs. Employees were exposed to struck-by/against hazards. NO ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.859(g):During demolition, continuing inspections by a competent person shall be made as the work progresses to detect hazards resulting from weakened or deteriorated floors, or walls, or loosened material. No employee shall be permitted to work where such hazards exist until they are corrected by shoring, bracing, or other effective means. a) On or about 03/12/2024, during the demolition project at 80 North Main Street, located in Fairport, New York, the employer did not enforce safe working practices while in the process of a concrete floor removal. Employees were allowed to continue demolition activity on working surfaces using jack hammers and other demolition tools creating weakness on the strength of the working surfaces and other structures. Employees were exposed to floor collapse and cave-in hazards. NO ABATEMENT CERTIFICATION REQUIRED
