29 CFR  1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazard(s) identified.  The employer failed to: 1.   Select the appropriate PPE identified in the hazard assessment;  2.  Communicate selection decisions to each affected employee;  3.  Ensure that the selected PPE properly fits each affected employee.  On or about July 22, 2024, employees were dumping bags of raw corrosive materials into a blender wearing an industrial lab coat with cloth like fabric. Employees were exposed to corrosive substances both in liquid and solid form, such as but not limited to Linr C12-C16 Alcohol 7 Mole Ethoxylate, also known as Tomadol 25-7 Sufactant, Sod Alkyl Benz Sulfonate 90% Flake, also known as Calsoft F-90 ECL, and Lutensol XP50 also known as ethoxylated alcohol,  specifically  to their body. The employer did not select or use the type of personal protective equipment that would protect the affected employee from the hazards identified.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.133(a)(1):Eye and face protection. General requirements.  The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about July 22, 2024, employees were dumping bags of raw corrosive materials into a a  blender using their eye glasses.  Employees were exposed to corrosive substances both in liquid and solid form, such as but not limited to Linr C12-C16 Alcohol 7 Mole Ethoxylate, also known as Tomadol 25-7 Sufactant, Sod Alkyl Benz Sulfonate 90% Flake, also known as Calsoft F-90 ECL, and Lutensol XP50 also known as ethoxylated alcohol, to their eyes.  The employer did not ensure that exposed employee uses appropriate eye or face protection when  exposed to eye or face hazards from flying particles and caustic liquids.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.134(c)(1):In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i)-(ix) with worksite-specific procedures:  On or about March 15, 2024, through July 22, 2024, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i)-(ix).  The employer required employees to wear respirators throughout their shifts while exposed to respiratory hazards such as corrosive materials.  The employees were required to wear respirators, 52P71 Half Face 3M respirators, to protect from airborne hazards.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.13(d).

29 CFR  1910.151(c):Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use.  Blending Department:  On or about March 15, 2024 through July 22, 2024, employees dumping bags of raw materials into the blender were exposed to respiratory and chemical hazards specifically corrosive materials such as but not limited to Glucopon (420UP), Bio-Terge AS-90 Beads, Linr C12-C16 Alcohol 7 Mole Ethoxylate, also known as Tomadol 25-7 Sufactant, Sod Alkyl Benz Sulfonate 90% Flake, also known as Calsoft F-90 ECL, and Lutensol XP50 also known as ethoxylated alcohol.  There were no suitable facilities in the vicinity of the blending department to quickly drench the skin of the employees in the event of exposure to corrosive materials.     Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  1.  Labels and other form of warning; 2.  Safety data sheets; 3. Employee information and training 4.  Methods to inform employees of the hazards on non routine tasks;   Blending Department:  On or about March 15, 2024 through July 22, 2024, employees dumping bags of raw material into the blender were exposed to respiratory and chemical hazards specifically combustible and corrosive materials, such as but not limited to  Sod Alkyl Benz Sulfonate 90% Flake, also known as Calsoft F-90 ECL, Linr C12-C16 Alcohol 7 Mole Ethoxylate, also known as Tomadol 25-7 Sufactant, and Lutensol XP50 also known as ethoxylated alcohol.   The employer did not develop, implement, and or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
