29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. On and before March 21, 2024, with respect to an establishment located at 513 W. 9th Avenue, Oshkosh, WI 54903, employees were operating a Nissan Model KPHO2A25PV, LP Powered Forklift with a Ballymore Manlift Attachment. The employer did not ensure that the lift was equipped with a plate, tag or decal outlining the safe operating procedures and maintenance of the lift.

29 CFR 1910.217(b)(7)(iii): A means of selecting Off, "Inch," Single Stroke, and Continuous (when the continuous function is furnished) shall be supplied with the clutch/brake control to select type of operation of the press. Fixing of selection shall be by means capable of supervision by the employer. On and before March 21, 2024, with respect to an establishment located at 513 W. 9th Avenue, Oshkosh, WI 54903, the employer did not ensure that the 60-Ton Federal Part Revolution Press, Serial No. PR-0006, "Big Fed", had a method where the selection of the Off, "Inch," Single Stroke, and Continuous modes could be fixed under supervision of the employer, as the key for selecting those modes had been left in the press.
