(a) Joel Garcia Lopez, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a repeat serious violation of 29 CFR 1926.20(b)(2) with an abatement date of August 26, 2024.  Citation 1, Item 2, a repeat serious violation of 29 CFR 1926.102(a)(1) with an abatement date of August 20, 2024. 29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) On or about March 28, 2024, at the job site located at N57W18723 Dandelion Court, Menomonee Falls WI, the employer who was the competent person, did not ensure frequent and regular inspections of the job site were conducted to identify hazards and the job sites were maintained safe.  The JC Siding, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1674359, citation number 1, item number 1, and was affirmed as a final order on 1/11/2024, with respect to a workplace located at 9714 Bergamont Drive, Franklin, WI 53132.  The JC Siding, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1643732, citation number 1, item number 1, and was affirmed as a final order on 3/24/2023, with respect to a workplace located at 1825 Yorkville Meadows, Union Grove, WI 53182.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about March 28, 2024, at the job site located at N57W18723 Dandelion Court, Menomonee Falls WI, employees were installing roof sheathing with pneumatic nail guns without the use of eye protection. 29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):    (a) On or about March 28, 2024, at the job site located at N57W18723 Dandelion Court, Menomonee Falls WI, employees were installing shingles on the roof of a residential building with a pitch of 6:12, with a fall height of approximately 12 feet without fall protection in place, thereby exposing the employees to a fall hazard.  The JC Siding, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1674359, citation number 1, item number 2, and was affirmed as a final order on 1/11/2024, with respect to a workplace located at 9714 Bergamount Drive, Franklin, WI 53132. 29 CFR 1926.1053(b)(1): Where a portable ladder(s) was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a) On or about March 28, 2024, at the job site located at N57W18723 Dandelion Court, Menomonee Falls WI, the Werner Extension ladder erected on the East side of the structure, at the front entrance, and being used for access to the 6:12 pitched roof, did not extend at least three (3) feet above the landing edge, and/or was not secured to the structure when it was not sufficiently extended. This exposed employee(s) accessing the roof to a fall hazard of approximately 11 feet, 2 inches.
