29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  Employees engaged in residential framing activities at the jobsites located at 12113-12115 Swift Fox Maize, Kansas, were exposed to fall hazards of approximately 9 feet 4 inches from the roof to the ground below in that fall protection was not utilized.  The Guillermo De La Torre Gonzales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1708200, citation number 1, item number 2 and was affirmed as a final order on 01-23-2024, with respect to a workplace located at 5339 N. Pinecrest Ct. N. in Bel Aire, Kansas.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain programs necessary to ensure compliance with the Occupational Safety and Health Standards:  Employees engaged in residential framing activities at the jobsites located at 12113-12115 Swift Fox Maize, Kansas, were exposed to struck-by, fall hazards, in that the employer failed to maintain a safety and health program to address hazards such as but not limited to fall protection during construction activities. A safety and health program with policy, hazard assessment, and work site rules was not developed and/or implemented at this job site.
