29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 811 South Queen Ave. Maize, KS 67101, employees engaged in roofing activities were exposed to chemical hazards when handling CertainTeed LandMark Pro AR asphalt shingles, Titebond WeatherMaster metal roof sealant, and gasoline. The employer did not maintain and update their written hazard communication program to reflect alignment with the globally harmonized system (GHS) as required by the revised hazard communication standard (HCS 2012). Section 17.3 of the hazard communication program has not been updated from Material Safety Data Sheets (MSDS) to Safety Data Sheets (SDS). The chemical hazards associated with these chemicals include: skin and eye irritation, may cause an allergic skin reaction, drowsiness and/or dizziness, respiratory tract irritation, nausea, gastric or intestinal disorders, suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, gasoline, can act as a fueling agent due to its extreme flammability as a liquid and vapor.
