29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 12113-12115 Swift Fox St. Maize, KS 67101, employees engaged in residential framing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling Keson ProChalk permanent marking chalk, diesel fuel, and gasoline. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, diesel fuel and gasoline, can both act as a fueling agents due to their extreme flammability as a liquid and vapor.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: (Construction Reference: 1926.59) At the job site located at 12113-12115 Swift Fox St. Maize, KS 67101, employees engaged in residential framing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets (SDSs) for Keson ProChalk permanent marking chalk, diesel fuel, and gasoline at the job site. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, diesel fuel and gasoline, can both act as a fueling agents due to their extreme flammability as a liquid and vapor.
