OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to potential oxygen deficient atmospheres:    a)	Refrigeration Mechanical Machine Room:  On or about April 2, 2024, and at times prior to, the employer exposed employees to 3700 pounds of anhydrous ammonia inside the refrigeration machine room and did not have safety systems in place such as but not limited to an alarm detection system that is interlocked with mechanical ventilation when employees enter the area for maintenance activities.

29 CFR  1910.95(g)(5)(i):The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared:  a) Robotic palletizer and bagging system operator :   On or about April 5, 20124 and at times prior to, the employer exposed employees to noise dose at levels of 67.9% (equivalent to an 8 hour time weighted average TWA of 87.2 dBA) which is 1.35 times the Action Level of 50% (equivalent to a calculated and corrected TWA of 83.7 dBA) while operating the Hamer Fischbein Model 540A, Serial Number 17540182 Robotic stacker and bagging conveyor system. Results were calculated for a 575-minute sampling period.  The employer failed to provide a baseline audiometric test to the employee.

29 CFR  1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a)	Mechanical Compressor Area:  On or about April 5, 2024, and at times prior, the employer exposed employees to loss of vision and skin burns and rashes, in that there was no approved emergency eyewash in the work area for immediate emergency use while employees performs daily maintenance tasks in the compressor room that contains 3700 pounds of corrosive anhydrous ammonia in the refrigeration system.   b)	Production Area:  On or about April 5, 2024, and at times prior, the employer exposed employees to loss of vision and skin burns and rashes, in that no  approved emergency eyewash in the work area for immediate emergency use while employees while performing daily sanitation job tasks of using corrosive sanitizer Meyer-066R in a hand sprayer to sanitize production equipment.
