Except as provided in paragraphs (a)(2), (a)(3), (a)(4), (a)(5) and (g) of this section, each scaffold and scaffold component shall be capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it. One or about April 5, 2024, at 3435 Calumet Avenue in Manitowoc, Wisconsin, employees were exposed to a fall hazard while climbing on a scissor lift mid-rail to access a roof surface. The scaffold platform was 35 inches below the top edge of the roof parapet wall.

Direct access to or from another surface shall be used only when the scaffold is not more than 14 inches (36 cm) horizontally and not more than 24 inches (61 cm) vertically from the other surface. One or about April 5, 2024, at 3435 Calumet Avenue in Manitowoc, Wisconsin, employees were exposed to a fall hazard while accessing a scissor lift platform from a roof's parapet wall without the platform positioned 24 inches or less below the top of the parapet wall. The platform was 35 inches below the top of the parapet wall.

For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. One or about April 5, 2024, at 3435 Calumet Avenue in Manitowoc, Wisconsin, employees were exposed to a fall hazard while using a scissor lift to access a roof surface at 20 feet above surface level without using a complete guardrail system on the platform. The platform's access gate was not closed to complete the guardrail system.

29 CFR 1926.454(a)(3): Scaffolds. Training requirements. The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the proper use of the scaffold, and the proper handling of the materials on the scaffold. One or about April 5, 2024, at 3435 Calumet Avenue in Manitowoc, Wisconsin, the employer did not provide required scaffold safety training for employees who were using a JLG RT3369 scissor lift at heights greater than 10 feet without a required fall protection system and without using the gate to access/egress the platform.
