On or about April 29, 2025, the portable job-made ladder used to access the higher level did not have level and/or uniformly spaced steps, thereby exposing employees to fall hazards. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about April 29, 2025, the portable job-made ladder used to access the upper level of the roof did not extend at least three (3') feet above the upper landing surface, thereby exposing employees to fall hazards. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. On or about April 29, 2025, The employer did not ensure that supported scaffolds from which employees worked were free of potential fall hazards. Employees working at approximately 11.4 feet or more above a lower level were not protected from falling to that lower level by fall protection while conducting commercial construction activities. Pro Design Construction, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1630594, citation number 1, item number 3 and was affirmed as a final order on January 13, 2023, with respect to a workplace located at 416 Irving Park, Wood Dale, IL 60191.

29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about April 29, 2025, employees were exposed to falls of approximately 17.0 feet to ground level while engaged in construction activities. Fall protection was not being utilized while performing commercial siding work at the edge of the roof. Pro Design Construction, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1739530, citation number 1, item number 2 and was affirmed as a final order on August 21, 2024, with respect to a workplace located at 3435 Calumet Avenue, Manitowoc, WI 54220.
