29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Ochoa V Construction, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of September 18, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) On or about April 5, 2024, employees who were performing roofing work on a residential house were not using fall protection and had not received fall protection training.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about April 5, 2024,  employees were operating pneumatic nail guns without eye protection while installing shingles. This exposed employees to a struck-by hazard and eye injury.  The Ochoa V Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1650714, citation number 1, item number 1b, and was affirmed as a final order on 5/23/23, with respect to a workplace located at 25900 77th Place, Salem WI 53168.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) On or about April 5, 2024, employees conducting roofing activities (shingle installation) on a 6:12 pitch roof of the main house structure were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 13 and 1/10 feet.  (b) On or about April 5, 2024, employees conducting roofing activities (shingle removal) on a 6:12 pitch roof of the attached garage structure were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately eight (8) feet.  The Ochoa V Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1650714, citation number 1, item number 2, and was affirmed as a final order on 5/23/23, with respect to a workplace located at 25900 77th Place, Salem WI 53168.
