29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Site; Roof: On or about April 5, 2024, employees were exposed to fall hazards of approximately 10-feet, 5-inches to ground level, in that the employer allowed workers to apply framing material on the second floor of a new construction residential home without a fall protection system.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Interior of structure; worksite: on or about April 5, 2024, the employer exposed employees to fall hazards of approximately 10-feet, 5-inches, in that the ladder used for accessing the second story of the new construction residential home was not extended a minimum of three-feet above the upper landing surface. The ladder was only extended approximately one foot above the landing surface while employees engaged in framing activities.
