29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail guns and circular saws.  Location: Job site;  On or about 04/09/2024, employees were allowed to operate 2 Metabo NR83A5 series pneumatic nail guns and one Makita 5007F series circular saw without eye or face protection to protect against potential flying objects, debris, or shrapnel.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  Location: Job site;  On or about 04/09/2024, employees were allowed to engage in framing activities without the use of fall protection while installing roof decking on a residential roof that was 21-feet above the ground below.  De Almeida Carpentry Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1632420, citation number 1, item number 1 and was affirmed as a final order on 02/23/2023, with respect to a workplace located at 118 East Main Street, Merrimac, MA 01860.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  Location: Job site;  On or about 04/09/2024, employees were witnessed performing framing activities on the roof of a residential structure 21-feet above the ground below. Employees on-site had not been provided fall protection training by the employer prior to allowing them to perform duties which exposed them to potential fall hazards.  De Almeida Carpentry Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.503(a)(1)), which was contained in OSHA inspection number 1632420, citation number 1, item number 2 and was affirmed as a final order on 02/23/2023, with respect to a workplace located at 118 East Main Street, Merrimac, MA 01860.
