29 CFR 1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, was not protected by protective helmets. At the residential construction jobsite located at 18773 W. 169th Street, Olathe, Kansas, an employee was exposed to overhead struck-by hazards. The employee was observed working in a trench underneath the bucket of a Caterpillar Backhoe Model 420 without the use of a protective helmet.

A stairway, ladder, ramp or other safe means of egress was not located in trench excavations more than 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. At the residential construction jobsite located at 18773 W. 169th Street, Olathe, Kansas, an employee was exposed to struck-by and engulfment hazards. The employee was observed working inside of a trench measured at approximately 11 feet deep without a ladder or other safe means of egress in which to access.

The employee was observed working in a trench measured at approximately 11 feet deep without adequate shoring, sloping or benching as a means of protection against trench collapse.
