29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  At the residential construction jobsite located at 16880 S. Norton Street, Olathe, Kansas, an employee was exposed to struck-by and engulfment hazards. The employee was observed working in a trench measured at approximately 5 feet, 8 inches deep without adequate shoring, sloping or benching as a means of protection against trench collapse.  Garrison Excavating, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1740160, citation number 1, item number 3 and was affirmed as a final order on 08-05-2024, with respect to a workplace located at 18773 W. 169th Street, Olathe, Kansas 66062.

A stairway, ladder, ramp or other safe means of egress was not located in trench excavations more than 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  At the residential construction jobsite located at 16880 S. Norton Street, Olathe, Kansas, an employee was exposed to struck-by and engulfment hazards. The employee was observed working inside of a trench measured at approximately 5 feet 8 inches deep without a ladder or other safe means of egress in which to access.  Garrison Excavating, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1740160, citation number 1, item number 2 and was affirmed as a final order on 08-05-2024, with respect to a workplace located at 18773 W. 169th Street, Olathe, Kansas 66062.
