29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) JC Roofing Contractor LLC, failed to document abatement within 10 calendar days after the abatement date that the following cited violation had been corrected:  Citation 1, Item 1 a Serious violation of 29 CFR 1926.102(a)(1) with an abatement date of  September 3, 2024.  Citation 2, Item 1 a Willful Serious violation of 29 CFR 1926.501(b)(13) with an abatement date of  September 3, 2024.  Citation 3, Item 1 a Repeat Serious violation of 29 CFR 1926.503(a)(1) with an abatement date of  September 20, 2024.  Citation 3, Item 2 a Repeat Serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of  September 3, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee was using eye or face protection when exposed to eye or face hazards from flying particles.  (a) On or about April 10, 2024, at the jobsite located at 1443 Oriole Drive, Hartford, WI 53027, employees were operating pneumatic nail guns without eye protection while installing a new roof on an existing residential home. This exposed employees to a struck by hazard and eye impalement injury.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a)  On or about April 10, 2024, at the jobsite located at 1443 Oriole Drive, Hartford, WI 53027, employees conducting roofing activities on a residential roof with a 10:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 22 feet on the East side of the residential home.

Juan Carlos Alvarez Govea dba Juan Carlos Alvarez Govea was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1715890, citation number 1, item number 2 and was affirmed as a final order on April 10, 2024, with respect to a workplace located at 3800 Sunnycrest Dr. Brookfield, WI 53005.  Juan Carlos Alvarez Govea dba Juan Carlos Alvarez Govea was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1607684, citation number 2, item number 2 and was affirmed as a final order on October 19, 2022, with respect to a workplace located at 2700 Golf Road, Delafield, WI 53018.  Juan Carlos Alvarez Govea dba Juan Carlos Alvarez Govea was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1470124, citation number 1, item number 2 and was affirmed as a final order on April 23, 2020, with respect to a workplace located at 1722 Hunter Road in Waukesha, WI 53189.
