29 CFR 1910.133(a)(1): Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment: Food Preparation Area: On, or about, April 11, 2024, protective eyewear was not provided to employees who used Chemco Dirt Buster III Oven Cleaner to clean the Merry Chef ovens. The Safety Data Sheet provided for the cleaner stated that it could cause chemical burns to eyes and the employer's Personal Protective Equipment hazard assessment for the cleaning task required the use of protective eye equipment.

29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes: Food Preparation Area: On, or about, April 11, 2024, employees used vinyl food preparation gloves when cleaning the Merry Chef ovens with Chemco Dirt Buster III Oven Cleaner. The Safety Data Sheet provided for the cleaner stated that it could cause skin irritation and the Personal Protective Equipment hazard assessment for the cleaning task required the use of nitrile gloves.

Employees had been provided with general Hazard Communication training, but had not been trained regarding work procedures to minimize exposure to the chemical such as, but not limited to, how to apply the cleaner, what work practices to utilize and what personal protective equipment was required to minimize exposure.
