29 CFR 1926.651(j)(1): Adequate protection shall be provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection. a) On or about 04/22/2024, at the Arbor at Penfield Townhouse project, located in Penfield, New York, the employer did not enforce the use of cave-in protection for employees working in a trench 6 feet 4 inches below grade. Employees were allowed to access water mains inside a trench with no protective systems in place. NO ABATEMENT CERTIFICATION REQUIRED
