OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to impalement hazards: a) On or about 07/17/2024, during the process of laying concrete slabs at the entrance of the Performing Arts Center at the Spencerport High School, located at EJ Wilson and Lyell Road, in Spencerport, New York, the employer did not enforce safety practices such as, but not limited to: guarding form stakes and/or provided suitable covers to prevent employees from potential impalement hazards NO ABATEMENT CERTIFICATION REQUIRED
