29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): On or about April 22, 2024, employees were exposed to fall hazards and the employer did not ensure fall protection was used: a. Employees working in the Cocoa Butter Unloading area were exposed to fall hazards while accessing tanker trucks from the C3 work platform and the employer did not ensure fall protection was used when retrieving samples. b. Employees working in the West Plant Tank Farm were exposed to fall hazards while accessing the the top hatches of liquid milk tanker trailers and the employer did not ensure fall protection was used when retrieving samples.
