29 CFR 1910.212(a)(1): The employer failed to ensure one or more methods of machine guarding be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are barrier guards, two-hand tripping devices, electronic safety devices, etc. a. On or about April 22, 2024, the employer failed to provide effective guarding to protect employees working at or near the Toppings line #2- Quantum Pepperoni Slicer Model: TP20099/ Serial Number: TP2170003 from pinch point hazards to their hands and fingers. A machine operator was placing pepperoni sticks into the cluster when a pepperoni stick fell, and the employee reached into the machine and partially amputated the right hand middle and ring fingers from a pinch point. b. On or about April 24, 2024, the employer failed to provide effective guarding to protect employees working at or near the Toppings line #1 Wexxar WF30H Automatic Case Former Machine Serial Number: 6254 from pinch point and crushing hazards to their hands and fingers. A machine operator was exposed to pinch points and crushing hazards from the jaw plates and the compression platen.
