29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  On or about April 25, 2024, at a work location located at 8500 Traphagen ST NW, Massillon Ohio 44646 the employer, Twin Creek Roofing Services, LLC did not initiate and maintain safety and health programs related to the roofing work that included work rules, hazard detection and site safety enforcement. Employees were performing work on the roof of a commercial building at heights over 19.2 feet without any form of fall protection, using pneumatic nail guns without eye protection and using an improperly configured ladder for roof access/egress which exposed the employees to falls and struck-by hazards.

29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   On or about April 25, 2024, at a work location located at 8500 Traphagen ST NW, Massillon Ohio 44646 the employer, Twin Creek Roofing Services, LLC did not instruct each employee in the recognition and avoidance of unsafe conditions and the methods for eliminating hazards applicable to the construction work being performed.  Employees were performing work on the roof of a commercial building at heights over 19.2 feet without any form of fall protection, using pneumatic nail guns without eye protection and using an improperly configured ladder for roof access which exposed the employees to falls and struck-by hazards.

On or about April 25, 2024, at a work location located at 8500 Traphagen ST NW, Massillon Ohio 44646 the employer, Twin Creek Roofing Services, LLC did not ensure eye protection was utilized by employees using pneumatic nail guns and hand tools to install roofing shingles, exposing the employees to struck-by hazards to the eyes.

29 CFR  1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.   On or about April 25, 2024, at a work location located at 8500 Traphagen ST NW, Massillon Ohio 44646 the employer, Twin Creek Roofing Services, LLC did not ensure employees engaged in commercial roofing activities over 6 feet were protected from falls. Employees were exposed to falls of 19.2 feet above the ground while tearing off and installing roofing shingles on a roof without utilizing any form of fall protection.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   On or about April 25, 2024, at a work location located at 8500 Traphagen ST NW, Massillon Ohio 44646 the employer, Twin Creek Roofing Services, LLC did not ensure that a ladder used for accessing the roof of a commercial facility extended at least 3 feet beyond the upper landing surface and/or was secured at the top with a grasping device, exposing employees to falls over 19.2 feet.
