29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces by complying with paragraphs (c)(1), (c)(2), and (c)(8) of this section: (a) On or about April 24, 2024, the employer exposed employees to potential health hazards, in that the sorbent wastewater tanks were not evaluated or identified by signage of the danger posed by accessing the tanks.
