See 29 CFR  1910.23(b)(1): The employer must ensure that ladder rungs, steps, and cleats are parallel, level, and uniformly spaced when the ladder is in position for use.  a) On or about and at times prior to May 2, 2024, at the establishment located at 11852 State Highway 32 East, Suring, Wisconsin; near the Gang Saw, the employer did not ensure that the ladder rungs on the fixed ladder used to access the Gang Saw were uniformly spaced, exposing employees to fall hazards.

29 CFR  1910.265(c)(5)(i): Stairways shall be constructed in accordance with 29 CFR part 1910, Subpart D. In accordance with 29 CFR 1910.25(b)(1) Handrails, stair rail systems, and guardrail systems are provided in accordance with 29 CFR 1910.28, 29 CFR 1910.25(b)(3) Stairs have uniform riser heights and tread depths between landings, and 29 CFR 1910.28(b)(11)(iii):  Each ship stairs and alternating tread type stairs is equipped with handrails on both sides.  On or about and at times prior to May 2, 2024, at the establishment located at 11852 State Highway 32 East, Suring, Wisconsin; the employer did not ensure that stairways were constructed in accordance with 29 CFR 1910, Subpart D, exposing employees to fall hazards in the following instances:   a) The stairway providing access to the Big Trimmer and Small Trimsaw was not equipment with handrails on both sides, exposing employees to fall hazards. b) The stairway providing access to the Edger did not have uniform riser heights between landings, exposing employees to fall hazards.

29 CFR  1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to (c)(4)(ii)(A) through (c)(4)(ii)(D) of this section.  On or about and at times prior to May 2, 2024, at the establishment located at 11852 State Highway 32 East, Suring, Wisconsin; the employer did not ensure that the equipment specific energy control procedures clearly and specifically outlined the rules and techniques necessary to control hazardous energy for employees who perform servicing and/or maintenance operations, such as but not limited to changing blades, exposing employees to contact with hazardous energies in the following instances:  a) The energy control procedure for the 5-Head Brewer Bandsaw (Manufacturer: Brewer, Inc., Model: 5HD Bandsaw, SN: 071806) did not clearly and specifically outline the rules and techniques necessary to control hazardous energy for employees who perform servicing and/or maintenance operations and the magnitude of hazardous energies.  b) The energy control procedure for the Splitter Saw (Manufacturer: In-House Fabrication) did not clearly and specifically outline the rules and techniques necessary to control hazardous energy for employees who perform servicing and/or maintenance operations and the magnitude of hazardous energies.

29 CFR  1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6).   a) On or about May 2, 2024, at the establishment located at 11852 State Highway 32 East, Suring, Wisconsin; an employee was exposed to machine hazards associated with moving parts when they engaged in blade changing on the 5-Head Brewer Bandsaw (Manufacturer: Brewer, Inc., Model: 5HD Bandsaw, SN: 071806). The employer did not ensure that an employee had implemented energy control application steps or equivalent protective measures prior to allowing them to perform blade changing. The machine was not isolated, such as but not limited to electrical, prior to the employee engaging in the servicing / maintenance activity.  b) On or about May 2, 2024, at the establishment located at 11852 State Highway 32 East, Suring, Wisconsin; an employee was exposed to machine hazards associated with moving parts when they engaged in blade changing on the Splitter Saw (Manufacturer: In-House Fabrication). The employer did not ensure that an employee had implemented energy control application steps or equivalent protective measures prior to allowing them to perform blade changing. The machine was not isolated, such as but not limited to electrical, prior to the employee engaging in the servicing / maintenance activity.  c) On or about May 1, 2024, at the establishment located at 11852 State Highway 32 East, Suring, Wisconsin; an employee was exposed to machine hazards associated with moving parts when they engaged in blade changing on the Splitter Saw (Manufacturer: In-House Fabrication). The employer did not ensure that an employee had implemented energy control application steps or equivalent protective measures prior to allowing them to perform blade changing. The machine was not isolated, such as but not limited to electrical, prior to the employee engaging in the servicing / maintenance activity.  As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.
