29 CFR 1910.272(g)(1)(iii): The atmosphere within a bin, silo, or tank in the grain handling facility was not tested for the presence of combustible gases, vapors, and toxic agents prior to employee entry: On or about May 6, 2024, Bin 4, employees entered the bin containing atmospheric hazards such as but not limited to hydrogen sulfide, phosphene, and nitrogen dioxide gases to perform rice grain milling activities including but not limited to cleaning and checking the area without performing atmospheric testing. Black River Commodities, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1658029, citation number 1, item number 1 and was affirmed as a final order on October 19, 2023, with respect to a workplace located at 910 Townsend Drive, Pocahontas, AR 72455.
