29 CFR 1910.178(g)(2): Battery charging apparatus for industrial trucks located in battery changing and charging installation was not protected from damage by trucks: On or about May 7, 2024, employees engaged in warehousing activities in the Pierce Building of Neogen Corporation located at 4616 Pierce Drive, Lincoln, Nebraska were exposed to potential electrocution and electrical shock hazards in that the employer has located the ENERGIC Plus battery charger on the operating floor without physical protection from incidental contact with the forklift. The operator is parking the forklift within 1 foot of the ENERGIC Plus during recharge.

29 CFR 1910.178(q)(1): Powered-operated industrial trucks not in safe operating conduction were not taken out of service, and/or repairs not made by authorized personnel: On or about May 7, 2024, it was documented that employees engaged in warehousing and/or material handling activities in the warehouse of Neogen Corporation located at 4131 North 48th Street, Lincoln, Nebraska were exposed to electrical shock/burn, and chemical contact hazards in that the employer did not ensure powered industrial trucks with mechanical deficiencies were taken out of service and/or repaired prior to use. Instances of trucks operated in unsafe condition included but were not limited to: i. Crown sit down forklift with exposed wiring at top, front light (as viewed from the front), and ii. Yale sit down forklift with severe deterioration cracking on the outer rubber layer of the mast hydraulic hose.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service: On May 7, 2024, it was documented that employees engaged in warehousing activities in the Pierce Building of Neogen Corporation located at 4616 Pierce Drive, Lincoln, Nebraska were exposed to electrical shock/burn, and chemical contact hazards in that the employer did not ensure powered industrial trucks were inspected prior initial use of the Yale or Crown forklift each day. Instances of unidentified issues as a result of the failure to inspect included but were not limited to: i. Crown sit down forklift with exposed wiring at top, front light (as viewed from the front), and ii. Yale sit down forklift with severe deterioration cracking on the outer rubber layer of the mast hydraulic hose.
