29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. (a) On or about May 10, 2024, at a jobsite located at 1820 W Brown Deer Rd. Brown Deer, WI 53223, the employer did not ensure employees on the roof of the structure engaged in re-roofing of a residential home were protected from fall hazards. This exposed employees to fall hazards of approximately 12 to 15 feet from the roof to the ground below. M-G-H Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1692522, citation number one, item number two and was affirmed as a final order on November 23, 2023, with respect to a workplace located at N94W17937 Appleton Ave Menomonee Falls, WI 53051.
