29 CFR  1910.1053(c):The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 g/m3, calculated as an 8-hour TWA:  A) On or about September 11, 2024, in the fabrication shop at Global Granite Corporation on 38 Corporate Park Drive #900, Pembroke, MA 02359, an employee was exposed to an 8-hour time weighted average respirable crystalline silica level of 76 micrograms per cubic meter in excess of the 50 microgram per cubic meter Permissible Exposure Limit (PEL) while polishing stone countertops. The company did not ensure the employee was exposed to levels below 50 micrograms per cubic meter.  B) On or about September 11, 2024, in the fabrication shop at Global Granite Corporation on 38 Corporate Park Drive #900, Pembroke, MA 02359, an employee was exposed to an 8-hour time weighted average respirable crystalline silica level of 88 micrograms per cubic meter in excess of the 50 microgram per cubic meter Permissible Exposure Limit (PEL) while polishing stone countertops. The company did not ensure the employee was exposed to levels below 50 micrograms per cubic meter.

29 CFR  1910.1053(f)(1):The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible:  A) On or about September 11, 2024, in the fabrication shop at Global Granite Corporation on 38 Corporate Park Drive #900, Pembroke, MA 02359, an employee was exposed to an 8-hour time weighted average respirable crystalline silica level of 76 micrograms per cubic meter in excess of the 50 microgram per cubic meter Permissible Exposure Limit (PEL) while polishing stone countertops. The company did not implement enough engineering and work practice controls to reduce and maintain the employee's exposure to respirable crystalline silica to below the PEL. 29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  A) On or about September 11, 2024, in the fabrication shop at Global Granite Corporation on 38 Corporate Park Drive #900, Pembroke, MA 02359, an employee was exposed to an 8-hour time weighted average noise level of 87.5 dBA (equivalently a dose of 70.9 %) in excess of the 85 dBA action level (equivalently a dose of 50%) while polishing stone countertops. A hearing conservation program was not fully implemented including monitoring, baseline & annual audiometric testing, noise training, and posting of standard 29 CFR 1910.95.
