29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average (TWA) sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  On or about 31 May 2024, Atlas Iron Works had at least one employee exposed to an 8-hour TWA of 87.2 decibels measured on the A scale. Atlas Iron Works did not have an effective hearing conservation program in place as described in 29 CFR 1910.9(c) while at least one employee had noise exposure equal to or exceeding an 8-hour TWA level of 85 decibels.

29 CFR 1910.1200(g)(10): The employer did not ensure that, in all cases, the required information was provided for each hazardous chemical, and was readily accessible during each work shift to employees when they were in their work area(s):  On or about 16 May 2024 Atlas Iron Works had paint/primers in use without a readily accessible SDS for employees to review. Atlas Iron Works was in the process of completing their SDS book.
