29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) 650 W Colfax Ave Denver, CO 80204; Roof: On or about May 9, 2024, and at times prior, as the controlling and exposing employer, did not ensure that all Embrey employees and employees of sub-contractors were protected from falls of more than six feet in that the roof of the building ( eight stories) had unprotected sides and edges on all four exterior sides as well as the interior edges of the top floor. This exposed employees and subcontractor employees to fall hazards.

29 CFR 1926.1052(b)(2): Foot traffic was not prohibited on skeleton metal stairs where permanent treads and/or landings were to be installed at a later date and the stairs were not fitted with secured temporary treads and/or landings long enough to cover the entire tread or landing area: a) 650 W Colfax Ave Denver, CO 80204; Stairway: On or about May 9, 2024, and at times prior, employees were exposed to trip hazards in that unfilled pan stairs were used as the main thoroughfare for employees to move between levels.
