29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Alexander's Construction, LLC at 47014 SD Hwy 44, Worthing, SD 57077: On or about and at times prior to May 15, 2024, the employer did not ensure that all Powered Industrial Truck ("PIT") operators were competent to operate the JCB Telehandler, Model 509-42F, safely by a successful completion of a training program.  This condition exposed employees to struck-by hazards associated with improper forklift operations.

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Alexander's Construction, LLC at 47014 SD Hwy 44, Worthing, SD 57077: On or about and at times prior to May 15, 2024, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person.   This condition exposed employees to fall hazards, Powered Industrial Truck hazards, and a lack of training.

This condition exposed the employees to fall hazards greater than six feet.
