29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) On or about May 21st, 2024 at the address of 212 Main Street, SWANTON, OH 43558: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.  The Victor Manuel Garcia DBA Macri Roofing was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1636291 , citation number 1, item number 1a, and was affirmed as a final order on 3-14-2023, with respect to a workplace located at 1127 Colton Street Toledo, Ohio 43609.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about May 21st, 2024 at the address of 212 Main Street, SWANTON, OH 43558: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing roofing operations from elevated surfaces greater than six feet from the level below. 29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) On or about May 21st, 2024 at the address of 212 Main Street, SWANTON, OH 43558: The employer did not ensure employees were protected from falls while performing roofing work activities (removing old shingles/re-sheathing OSB) atop a single story residential structure with an 8 -12 roof pitch. Employees operating in this condition were exposed to falls of 10 feet to the ground below.  The Victor Manuel Garcia DBA Macri Roofing was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1636291 , citation number 1, item number 2, and was affirmed as a final order on 3-14-2023, with respect to a workplace located at 1127 Colton Street Toledo, Ohio 43609.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) On or about May 21st, 2024 at the address of 212 Main Street, SWANTON, OH 43558: The employer did not ensure employees using aluminum ladder had their side rails extended at least three feet above the landing surface. Five employees performing roofing work activities were exposed to fall hazards while using a ladder to access/exit roof on a single story residential structure with a height of approximately 10 feet  from ground below.  The Victor Manuel Garcia DBA Macri Roofing was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1636291 , citation number 1, item number 3a, and was affirmed as a final order on 3-14-2023, with respect to a workplace located at 1127 Colton Street Toledo, Ohio 43609.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  a) On or about May 21st, 2024 at the address of 212 Main Street, SWANTON, OH 43558: The employer did not provide a training program for each employee potentially exposed to fall hazards while using an aluminum extension ladder to access a single story residential roof structure. A training program would enable each employee to recognize the hazards of falling from the ladder and the procedures to be followed in order to minimize these hazards.
