29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D): On or about May 20, 2024, and times prior thereto, employees of Ostara Inc. working at a production facility located at 35 Bremen Avenue in Saint Louis, Missouri, were not protected from falling while working and walking around an uncovered hole in the roof. The employer did not ensure employees were protected from falling through skylights by either a cover or guardrail or ensuring employees wore a fall protection travel restraint or personal arresting system. Employees were exposed to fall hazards.

29 CFR 1910.28(b)(13)(ii): The employer did not ensure when work is performed at least 6 feet (1.6m) but less than 15 feet (4.6m) from the roof edge, each employee is protected from falling by using a guardrail system, safety net system, travel restraint system, or personal fall arrest system: On or about May 20, 2024, and times prior thereto, employees of Ostara Inc. working at the production facility located at 35 Bremen Avenue in Saint Louis, Missouri, were instructed to the roof of the building to use vacuums, shovels, and buckets to clean up mono ammonia phosphate which had spilled off the conveyor system. The employer did not ensure a fall protection system consisting of a guardrail, safety net, travel restraint or personal fall arrest system were worn while work was being performed on the roof at least 6 feet (1.6m) but less than 15 feet (4.6m) from the roof edge. The employees were exposed to fall hazards of approximately 30 feet to the ground below.
