The employer must provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces.  a) On and before 5/23/2024 the employer did not provide a safe access to the top of equipment such as but not limited to the Warmer Motor located on top of line #3 to prevent employees exposure to a caught in hazard while transitioning from a portable ladder over the moving conveyor system to the top of warmer to repair the motor.  Employees had to step over an 18" wide conveyor system from the ladder to the motor platform that measured at over 6' from ground.

29 CFR  1910.28(b)(1)(i): Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:  (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.  a) On 5/17/2024 the employer did not require the use of any type of fall protection system for employees who were exposed to the fall hazards of approximately 7' while performing such tasks as repairing the motor on top of the warmer.  During the servicing process, employees would climb up onto a ladder and stepping across the running conveyor system located 4 feet from the ground exposing employees to a total fall distance of 7 ft. fall while on the top of the warmer.

29 CFR  1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:  (2) Machine or equipment shutdown. The machine or equipment shall be turned off or shut down using the procedures established for the machine or equipment. An orderly shutdown must be utilized to avoid any additional or increased hazard(s) to employees as a result of the equipment stoppage. (3) Machine or equipment isolation. All energy isolating devices that are needed to control the energy to the machine or equipment shall be physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s). (4) Lockout or tagout device application. (4)(i) Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees. (4)(ii) Lockout devices, where used, shall be affixed in a manner to that will hold the energy isolating devices in a "safe" or "off" position. (6) Verification of isolation. Prior to starting work on machines or equipment that have been locked out or tagged out, the authorized employee shall verify that isolation and de-energization of the machine or equipment have been accomplished.  a) On 5/17/2024, the employer did not ensure that the energy procedures to control the #3 Warmer and the conveyor system of line #3, were followed by each authorized employee performing servicing and maintenance operations on equipment such as but not limited to; #3 Warmer.  Employees were exposed to a caught in hazard while transitioning  over the moving conveyor system to a platform located on top of the line #3 warmer while making repairs to the line #3 warmer motor.  The conveyor was not shut off, the electrical disconnect for the conveyor was not locked out by each authorized employee, not verification was made to ensure that the requirements of (d)2, (d)3, (d)4 and (d)6 were followed.  b) On 5/17/2024, the employer did not ensure that (d)(4 through (d)((6) were followed by authorized employees preforming servicing and maintenance operation on equipment such as but not limited to; the motor for the  line #3 Warmer.  Employees were exposed to a caught-in hazard while repairing the Warmer's motor in that employees pulled the fuses from the electrical panel to stop the Warmer from heating to allow the conveyor to continue to operate instead of following the energy control procedures for the line #3 Warmer to ensure that each energy source was secured.
