29 CFR 1910.178(q)(6): Industrial trucks were altered by the addition of extra parts not provided by the manufacturer. Additional counterweighting of fork trucks was not approved by the truck manufacturer. On or about May 28, 2024, and times prior thereto, warehouse employees performed material handling operations utilizing a modified forklift without prior written approval from the manufacturer.

29 CFR 1910.178(q)(7): Industrial trucks were being placed in services after the examination showed condition(s) adversely affecting the safety of the vehicle: On or about May 28, 2024, and times prior thereto, the employer failed to perform inspection the vehicles prior to allowing employees to use the for scrap metal handling operations in the following instances: a. The brake system had to be tied in place to operate safely. b. The front and side windows of the truck mounted material handling vehicle were cracked, broken or missing.
