29 CFR 1926.501(b)(13): The employer does not ensure that each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are protected by guardrail systems, safety net system, or personal fall arrest system, or provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a) Worksite - 49 Eustis Avenue, Newport, RI: On or about 5/29/2024, employees were exposed to fall hazards while performing roofing work approximately 23 feet above the lower level, without any means of fall protection.   The employer fails to ensure effective protections against falls in accordance with the standard, as demonstrated on 8/1/2023, when two employees were performing residential roofing work without utilizing fall protection.  MM General Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1687699, citation number 1, item number 2 and was affirmed as a final order on 10-25-2023, with respect to a workplace located at 20 Dr Marcus Wheatland Boulevard, Newport, Rhode Island 02840.   To abate this violation, the employer must ensure that all employees wear appropriate fall protection when an employee works more than 6 feet above the next lower level.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.
